Scope

These Terms of Service apply to the use of the service ClicksLeft (hereinafter "Service"), operated by Tom Silas Helmke (hereinafter "Provider"). By registering or using the Service, you agree to these Terms.

Subject Matter

ClicksLeft is an online service for creating self-destructing links. Users can create links with click limits, expiration dates, and password protection. The service includes various features such as URL redirects, secret text messages, and secure file sharing.

Registration and Account

Registration is required to use certain features.
You must be at least 16 years old.
The information provided during registration must be truthful and complete.
You are responsible for keeping your login credentials confidential.
Each person may only have one account.
The account is non-transferable.

Service Description

The service offers various plans:

Free: Free plan with limited features
Pro (€5/month): Extended features and higher limits
Business (€15/month): Team features and increased limits

All plans are subject to a fair use policy. Automated mass distribution, scraping, or abusive use is prohibited. In case of suspected abuse, we reserve the right to suspend the account.

Prices and Payment

All prices are final prices. Due to the small business regulation under § 19 UStG (German VAT Act), no VAT is charged or shown.
Payment processing is handled by the payment service provider Stripe. Stripe's terms of service apply.
Paid plans are billed monthly or annually in advance.
For annual subscriptions, we offer a discount equivalent to 2 months.
Invoices are delivered electronically by email.

Prohibited Content and Use

The following content and uses are strictly prohibited:

Content that violates applicable law
Child sexual abuse material (zero tolerance policy; such content is immediately reported to law enforcement)
Terrorist or violence-glorifying content
Malware, viruses, or harmful software
Content that infringes copyrights or other intellectual property rights of third parties
Spam, phishing, or fraudulent content
Automated mass distribution of links
Any form of service abuse

We reserve the right to immediately suspend accounts without warning in case of violations and to take legal action if necessary.

File Uploads

Allowed File Types

The service allows uploading and sharing of documents and certain file types. Only the following are permitted:

Documents: PDF, DOCX, DOC, ODT, RTF, TXT
Spreadsheets: XLSX, XLS, ODS, CSV, TSV
Presentations: PPTX, PPT, ODP
Code & Markup: HTML, CSS, JS, TS, JSON, XML, MD, YAML, TOML and other programming languages
3D & CAD: STL, OBJ, STEP, IGES, DXF, DWG, GCODE, BLEND, FBX
Design: SVG, AI, EPS
E-Books: EPUB, MOBI
Fonts: TTF, OTF, WOFF, WOFF2
Data: SQLite, DB
Other: ICS, VCF, TEX, BIB

Prohibited File Types

Explicitly NOT allowed are:

Images (JPG, PNG, GIF, WebP, etc.)
Videos (MP4, AVI, MOV, etc.)
Audio (MP3, WAV, etc.)
Archives (ZIP, RAR, 7z, TAR, etc.)
Executable files (EXE, MSI, BAT, SH, APP, DMG, DEB, RPM, etc.)

Reason: These restrictions protect against abuse, malware distribution, and illegal file hosting.

Disclaimer

The provider assumes no responsibility for the content of uploaded files
Files are downloaded by recipients at their own risk
We recommend scanning downloaded files with antivirus software before opening
Files are encrypted server-side, but NOT end-to-end encrypted like Secret Text

User Responsibility

You are solely responsible for:

The legality of uploaded content
Compliance with copyrights and other intellectual property rights
Obtaining necessary permissions for shared content

Consequences of Violations

In case of violations of these guidelines:

Immediate deletion of affected files
Account suspension without warning
Reporting to authorities in case of illegal content
No refund of payments already made

Cooperation with Authorities

The provider fully cooperates with law enforcement agencies and provides all available data upon legitimate requests.

Availability and Support

We strive for high availability of the service but cannot guarantee 100% uptime.
Maintenance work will be announced in advance when possible.
Support is provided via email. We aim to respond to inquiries within 48 hours.
Free accounts are not entitled to support.

Liability and Warranty

We are fully liable for intent and gross negligence.
For slight negligence, we are only liable for breach of essential contractual obligations and limited to foreseeable, typically occurring damage.
We are not liable for content created or shared by users.
We do not guarantee permanent storage of data beyond the specified periods.
Liability for data loss is limited to typical recovery costs.

Termination

Free accounts can be deleted at any time without giving reasons.
Paid subscriptions can be cancelled at the end of the respective billing period.
Cancellation can be made via account settings or by email.
Upon cancellation, all data will be deleted no later than 30 days after the end of the billing period.
We reserve the right to terminate accounts without notice in case of violations of these Terms.

Changes to Terms

We reserve the right to change these Terms. We will notify you of material changes by email at least 30 days before they take effect. If you do not object to the changes within 30 days of receiving the notification, the new Terms are considered accepted. In case of objection, you have a special right of termination.

Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for all disputes arising from this contract is, to the extent legally permissible, the place of business of the Provider (Cologne, Germany).

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
